Labor cases

Illegal dismissal, unpaid wages and benefits, and other money claims, for employees or employers.

Disputes at work are stressful for both workers and businesses. We assist employees and employers in labor matters, from conciliation at the Department of Labor to cases before the NLRC.

How we can help

  • Illegal dismissal complaints
  • Unpaid wages, overtime, 13th month pay and other benefits
  • SEnA (Single Entry Approach) conferences
  • Cases before the Labor Arbiter and the NLRC
  • Advice to employers on due process in discipline and termination
  • Appeals and remedies from labor decisions

How it usually proceeds

  1. SEnA. Most labor complaints begin with a mandatory 30-day conciliation conference under SEnA.
  2. Filing with the Labor Arbiter. If no settlement is reached, a complaint is filed before the Labor Arbiter.
  3. Position papers. The parties submit position papers and evidence. Labor cases are usually decided on these papers.
  4. Decision and appeal. The Labor Arbiter decides. The decision may be appealed to the NLRC within the period set by law.

This page is general information about this field of practice. It is not legal advice, and the process in your case may differ.
